No. TexArrest does not remove arrest or booking records solely because a case was dismissed, dropped, or resulted in no charges filed. A dismissal is not a legal expunction or sealing order. Records remain published unless a court has issued an official order requiring removal.
What qualifies for record removal from TexArrest?
Only the following:
- A court-ordered expunction
- A court-ordered sealing or nondisclosure order
- Any other signed judicial directive that legally requires removal of the arrest or booking event
Without one of these, the record will remain publicly accessible on TexArrest.
If I submit a removal request, is deletion guaranteed?
No. Submission of a request does not guarantee removal, editing, or annotation. All requests go through a compliance review to confirm legal validity.
Why publish arrest records if the case didn’t lead to conviction?
TexArrest reports public booking events, not guilt. An arrest record reflects that a person was taken into custody by law enforcement. It is not proof of conviction and should not be interpreted as evidence of guilt.
Do you remove mugshots or booking details if the person was never formally charged?
No. Even when a person was released before formal charges were filed, the booking event itself is still a public law-enforcement record. These records are not removed unless required by a court order.
What documents must I provide with a removal request?
You must upload at least one of the following:
- Official expunction order signed by the court
- Case sealing / nondisclosure order
- Certified court documentation clearly stating removal is mandated
We may also accept attorney-submitted documents if they are court-signed or certified by a solicitor depending on jurisdiction.
Can TexArrest remove a record if my lawyer or attorney requests it?
Only if the attorney provides a court-signed removal order. Attorney requests alone, letters, or legal opinions without a judicial order do not qualify.
Is there a fee for submitting a removal request?
No. Submission and review are free, but processing depends on legal verification and response times from public agencies or courts when applicable.
How long does review take?
Reviews are completed as quickly as possible, but may take additional time if we must verify the order directly with the issuing court.
